1. AGREEMENT TO OUR TERMS

These Terms and Conditions (“Terms”) are a legally binding agreement between you and Class Chat Inc. (“Class Chat,” “we,” “us,” or “our”) governing your access to and use of Class Chat, our web-based messaging and chatroom service available at classchat.us (the “Service”). We are a company registered in California, United States, with our registered office at 13333 Paramount Blvd, South Gate, CA 90280. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Class Chat is a consumer messaging service. It is not affiliated with, endorsed by, or integrated with any school or district, and it does not provide education records or school services.

We may update these Terms from time to time. We will indicate changes by updating the date of these Terms, and your continued use after changes take effect means you accept the updated Terms.

2. WHO CAN USE THE SERVICE

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or guardian where required. We do not knowingly collect personal information from children under 13; if we learn we have, we will delete it (see our Privacy Policy).

3. YOUR ACCOUNT

You are responsible for keeping your login credentials confidential and for all activity under your account. Provide accurate information, keep it current, and notify us promptly of any unauthorized use. We may suspend or terminate accounts that contain false information or that are used in violation of these Terms.

4. THE SERVICE IS FREE

Class Chat is provided free of charge to users. We do not charge fees for access to the Service. If we introduce any paid features in the future, we will disclose the terms and pricing before you incur any charge.

5. ACCEPTABLE USE

You agree not to use the Service to:

• Harass, bully, threaten, or harm others, or encourage others to do so;

• Post content that is illegal, hateful, sexually explicit, or that exploits or endangers minors;

• Share someone else’s private information without consent, or impersonate any person;

• Send spam or malware, or engage in phishing or fraud;

• Infringe intellectual property or other rights;

• Circumvent security, scrape the Service, use bots, or interfere with its operation; or

• Violate any applicable law or these Terms.

We may remove content and suspend or terminate accounts that violate these rules.

6. YOUR CONTENT

You retain ownership of the content you create (“Contributions”). You grant Class Chat a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your Contributions solely to operate and provide the Service — for example, to deliver your messages to the chatrooms you post them in. You are responsible for your Contributions and represent that you have the rights to share them. We do not claim ownership of your Contributions.

7. MODERATION

To keep the Service safe, we may review, filter, or remove content and restrict or terminate accounts, at our discretion, including through automated tools and reports from users. We are not obligated to monitor content but may do so to enforce these Terms and protect our users.

8. TERMINATION

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Provisions that by their nature should survive termination will survive.

9. THIRD-PARTY SERVICES

The Service may link to or rely on third-party websites or services that we do not control. We are not responsible for their content or practices, and your use of them is subject to their terms and policies.

10. DISCLAIMERS

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLASS CHAT AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

12. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Class Chat and its officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your Contributions, your use of the Service, or your violation of these Terms or the rights of others.

13. GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. For any dispute not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, and waive any objection to venue there.

14. CHANGES AND AVAILABILITY

We may change, suspend, or discontinue any part of the Service at any time. We are not liable for any modification, suspension, or discontinuance of the Service.
